Columbarium By-laws
Adopted November 14, 2012
ARTICLE 1 - OWNERSHIPSection 1). Elim Lutheran Church as been the vital center of the Scandia community for over 150 years. As such, the new columbarium will provide for a range of internment choices.
Section 2). The columbarium shall be under the care and control of the Elim Church Council who are hereby vested with full control and administration thereof subject to the provisions of these by-laws and other rules and regulations as may be adopted by the church through its council and by governmental laws relating thereto.
Section 3). The Elim Church Council is authorized to sell all niches at prices to be fixed by the church and to prepare and execute all necessary affidavits and conveyances thereof. They shall receive all monies owed to the columbarium and shall keep these funds apart from other funds and designate them as columbarium funds and shall make no payments therefrom except for purpose pertaining to the columbarium unless otherwise directed by the Elim Church Council. A full report shall be made at the annual meeting.
Section 4). The Elim church Council shall appoint a eight person committee to serve as the administrative body for the elim cemeteries including the columbarium.
Section 5). The Elim Cemetery Board shall supervise all activities relating to the columbarium including full and accurate records of all transactions, monies received and dispensed of all niches sold and all columbarium investments.
Section 6). The Elim Cemetery Board shall elect from its membership a Chairperson, Vice-Chairperson and other officers as deemed necessary.
Section 7). The Elim Church Council may appoint a cemetery Administrator who shall perform all necessary columbarium duties and keep records as instructed.
Section 8. Ownership of niches shall be subject to the following regulations:
a). Sale of a niche by the owner is prohibited except by surrender to the Elim Church Council as its original purchase price.
b). No more than four (4) niches may be purchased by any individual or group unless under unusual circumstances would require more. Such action would require Elim Church Council approval.
c). Gifts of niches are limited to the members of the immediate family of the owner, subject to Elim Church Council approval.
d). Laws of the State of Minnesota shall apply to inheritances of niches.
e). No transfer of niches shall be valid unless approved and recorded by the Elim Church Council.
f). No removal of cremated remains shall be done without written approval of the Elim Cemetery Board and the Church Council.
ARTICLE II - USE
Section 1). No interment in the columbarium shall be permitted until all pertinent Minnesota laws, rules and regulations established by the Elim Church Council and Elim Cemetery Board have been complied with, and all appropriate charges paid.
Section 2). Ownership of Niche
a). Includes the right to designate who shall be interred therein.
B. The Elim Cemetery Board assumes the responsibility to open and close the niche, order and install the engraved granite cover, and enforce regulations regarding standardized font and size of lettering.

ADDENDUM
Custody and control of the columbarium, its interment sites (niches) and all matters relating to its operation are vested in the Elim Church Council.
The Elim Cemetery Committee is delegated the authority to manage operations, the physical maintenance of the structure and surrounding landscaping, irrigation systems, snow plowing, planting and care of the trees and deciduous plants.
The daily administration of the columbarium business, handling of all funds, and keeping records of all transactions shall be vested in the church’s appointed columbarium Administrator as endorsed by the Elim Church Council.
